By signing up for or using any services provided by OpsEdge Hosting (“OpsEdge”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.
OpsEdge reserves the right to modify, update, or change these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the new terms.
2. Description of Services
OpsEdge Hosting provides shared web hosting, WordPress hosting, domain registration, and related services. Our services are intended for lawful use only and must comply with all applicable laws of Guyana and international regulations.
We provide server resources for hosting websites and email. We do not control, monitor, or edit the content you host, except when necessary to maintain service quality or comply with legal requirements.
3. User Responsibilities
- You are responsible for maintaining accurate account information and keeping your login credentials secure.
- You are solely responsible for backing up your website files, databases, and emails.
- You must ensure that any scripts, software, or content you install is secure and properly licensed.
- You agree to comply with our Acceptable Use Policy at all times.
4. Acceptable Use Policy
You may not use our services to:
- Host or distribute illegal content, copyrighted material without permission, or content that violates the rights of others.
- Engage in spamming, phishing, malware distribution, or any form of unsolicited bulk email.
- Run file-sharing services, torrent trackers, proxy servers, or IRC bots on shared hosting plans.
- Consume excessive server resources that negatively impact other customers.
- Host adult content, hate speech, or material that promotes violence or discrimination.
Note: OpsEdge is the sole judge of what constitutes a violation. Violations may result in immediate suspension or termination of services without refund.
5. Payment and Billing
All services are billed in advance. You are responsible for ensuring your payment information is up to date. Late payments may result in service suspension. Accounts with overdue invoices for more than 7 days may be terminated.
All fees are non-refundable except as outlined in our Refund Policy.
6. Refunds and Money-Back Guarantee
OpsEdge offers a 30-day money-back guarantee on most shared hosting and WordPress hosting plans. Refunds apply to hosting fees only and exclude domain registration fees, add-ons, and setup fees.
No refunds will be issued for accounts terminated due to violation of these Terms of Service or our Acceptable Use Policy.
7. Data Backup and Responsibility
You are fully responsible for backing up your own data. While we maintain server-level backups for disaster recovery, we are not responsible for any data loss due to hardware failure, hacking, accidental deletion, or any other cause.
8. Limitation of Liability
OpsEdge Hosting shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities, arising from the use or inability to use our services.
Our total liability shall not exceed the total amount you paid to us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless OpsEdge Hosting, its staff, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your content, or any violation of these Terms of Service.
10. Termination
OpsEdge may suspend or terminate your account at any time for violation of these Terms of Service, non-payment, abuse of support staff, or any activity that harms our network or other customers. No refund will be issued in such cases.
You may cancel your services at any time through your client area. You are responsible for backing up your data before cancellation.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Guyana. Any disputes shall be resolved in the courts of Guyana.
12. Changes to Terms
OpsEdge reserves the right to modify these Terms of Service at any time. Significant changes will be communicated via email or posted on our website. Continued use of our services after such changes constitutes acceptance.
